SKILLED REGIONAL PROVISIONAL VISA (SUBCCLASS 489)

Skills and efficiency are recognized and appreciated countries worldwide and hence the latter always search for talented, skilled and diligent individuals.

In today’s time, reaching from one part of the world to another is not a difficult task anymore. People migrate to distant areas for the purposes of study, work, business, marriage, medical treatments, holidays etc.

This spirit has proved to be beneficial for the government and employers of all countries as they can get the human capital from any corner of the world easily.

Looking at this scenario, people desire to move to different foreign countries for studying and working as they want to take advantage of the rising opportunities.

Australia is one of the most sought after destinations for people around the world as this country is not only well-established economically but has also a unique flavour in terms of culture, festivals, hospitality and other factors.

This is one of the visa categories, introduced by the Australian government, to motivate skilled individuals to work and settle in this country.

Who can apply?

As mentioned above, skilled workers under the age of 50 can apply for this visa to live and work in regional or low-population growth metropolitan areas of the country.

Entry routes

There are three entry routes or pathways to apply for this visa. In other words, there are three different situations in which one can become eligible to apply for this type of visa.

These situations can be explained as below:

       1. The Extended Stay Route:

       All those who are currently living in Australia through provisional visa in any one of the subclasses 475, 487, 495 and 496, can apply for this visa.

       2. The Invited route

       All those who have been either -

           i.) Nominated by an Australian State or Territory government agency or

           ii.) Sponsored by an eligible relative living in Australia

       3. The Subsequent route

           All those who are family members of someone who currently hold a Skilled Regional (Provisional) Visa (subclass 489) or a visa in any one of the subclasses 475, 487, 495 and 496.

Validity of Visa

       1. Invited Route: The validity period is 4 years from the date visa is granted.

       2. Extended Stay Route: The validity period is 4 years from the date you were granted the visa that you currently hold.

       3. Subsequent Route: The validity period is till the expiration of the visa, which your family member holds.

Eligibility criteria

You need to comply with the eligibility criteria as mentioned below to apply for this visa.

    1. Invited Route:

       1) Occupation:

              i.) If you are nominated by an Australian state or territory government agency, your occupation should be a part of the Medium and Long-term Strategic Skills List (MLTSSL), which is a pre-defined list of occupations.

              ii.) If you are sponsored by a relative, your occupation must be a part of the list of eligible skilled occupations.

       2) You need to show that you possess the required knowledge and skills for performing your job, through a skills assessment.

       3) You must be proficient in English language, which is certified by an internationally recognized English language.

       4) You need to score minimum 60 points for your EOI.

    2. Extended Stay Route:

       1) From the 4 permissible visa subclasses, you should not have held more than one of these visas ever.

       2) You should have complied with all the visa conditions of the visa, you hold currently.

How to apply?
    1. Invited Route:
      1) Submitting Expression of Interest (EOI) First, you need to submit an Expression of Desire (EOI) via the Australian government’s online system “SkillSelect”. This EOI contains all the valid and relevant information about you.     2) Receiving an Invitation To Apply (ITA)

    2. Extended Stay Route: You can apply through a proper channel.

    3. Subsequent Route: You can apply through a proper channel.

Living and working in Australia:
Invited Route:

    1) If you are nominated by an Australian state or territory government agency, you would have to work and live in a regional or low-population growth metropolitan area in Australia. The details of the same would be mentioned in your visa letter.

    2) If you are sponsored by a relative, you have to work and live in a designated area.

Extended Stay Route:

    1) If the visa that you hold currently was granted to you due to the nomination from a state of territory government, you have to live and work in a regional or low-population growth metropolitan area in the same state or territory that had nominated you.

    2) If the visa that you hold currently was granted to you due to the sponsorship provided by your relative, you can live and work in any designated area in any state or territory.

Subsequent Route:

    1) Your relative must be an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.

Certain important points to be considered:

1. Location:You can be in or outside Australia at the time of lodging application.

2. Debts:You must not have any outstanding debt towards Australian government. If you had the same previously, it must be repaid before applying.

3. Cancelled visa:If you have ever faced a visa cancellation or non-grant in the past while being in Australia, you might not be eligible to apply.
